Changes in military accounting for companies: how to comply with all legal requirements?

Legal Digest News
We present you an expert review of changes in legislation in the field of military registration and offer a solution from Acsour.

Currently, the maintenance of military records in companies is regulated by the following legislative acts:

  • Clause 7 of Article 8 of Federal Law No. 53-FZ dated 03/28/1998;
  • Clause 9 of the Decree of the Government of the Russian Federation dated 11/27/2006 No. 719;
  • Federal Law No. 132-FZ of 04/24/2020;
  • Order of the Ministry of Defense dated 11/22/2021 No. 700;
  • for employers — organizations located on the territory of the Republic of Crimea — Methodological recommendations, approved Resolution of the Territorial Commission of the Republic of Crimea on booking Russian citizens staying in reserve dated 03/13/2017 No. 6.

However, on November 1, 2024, Government Decree No. 506 of 04/19/2024 comes into force, which will supplement the regulatory framework on military accounting. Now employers will be required to enter data into a Single electronic register. The innovation in legislation creates both challenges and significant risks. Experts note that at the moment the legislator does not specify the need to submit reports in paper format, as well as responsibility for non-compliance with military records in electronic format.

Moreover, incorrect military registration is already threatened with the following fines:

  • 40 000 — 50 000 rubles — for officials for violations in providing military registration information and lists of citizens subject to initial military registration, as well as for violations in the procedure for handing over summonses to the military enlistment office and organizing an appearance on them;
  • 60 000 — 80 000 rubles — for officials for violations in the procedure of mobilization of citizens;
  • 350 000 — 400 000 rubles — for legal entities for violations in providing lists of citizens subject to initial military registration, as well as for violations in the procedure for handing over summonses to the military enlistment office and organizing attendance on them;
  • 400 000 — 500 000 rubles — for legal entities for violations in the procedure of mobilization of citizens.

The rapid digitalization of military accounting processes makes it possible to update and systematize information in the most convenient format for both legislators and citizens. However, switching to an electronic format may cause difficulties: we recommend that you get the advice of a specialized lawyer or a specialist in personnel document management.
