Parents with many children are now entitled to independently choose the timing of their vacations at their convenience

Amendments to the Russian Labour Code took effect on 22 October 2018 to establish new guarantees for families raising many children.
A new article entitled “The scheduling of annual paid leave for employees who have three and more children” has been introduced into the Labour Code. Thus, annual paid leave is now granted to parents with many children at their wish and its time is at their convenience. When drawing up a schedule of leave, employers must take account of the wishes of such employees. Both parents have the right to choose a convenient time for vacation. To take advantage of the guarantee a family must have at least three young children (under 12 years old).
If an employer infringes the employee’s right, it may be subjected to administrative liability under article 5.27 of the Code of Administrative Offenses, namely:

  • for legal entities, a fine of between RUB 30,000 and 50,000;
  • for a company’s officers, a warning, or a fine of between RUB 1,000 and 5,000;
  • for individual entrepreneurs, a fine of between RUB 1,000 and 5,000.

Sanctions are more stringent for repeated offenses:
  • for legal entities, a fine of between RUB 50,000 and 70,000;
  • for a company’s officers, disqualification for between 1 and 3 years, or a fine of between RUB 10,000 and 20,000;
  • for individual entrepreneurs, a fine of between RUB 10,000 and 20,000.
