A remote employee is not entitled to overtime for working on a day-off

LEGAL DIGEST \ 04.07.2018

The Federal Service for Labour and Employment explained that if a remote employee sets his working hours at his own discretion, he is not entitled to receive any overtime pay for working on his day-off.

If an employer has not set the working schedule in the employment agreement, it is impossible to determine whether a particular day was a working day or a day-off. Therefore, an employee cannot count on increased pay or compensatory time off under the general rules.
