Establishing the frequency of the inspection plan for 2023

LEGAL DIGEST, NEWS \ 11.08.2022

The Federal Service of Labor and Employment has published a list of companies subject to scheduled inspections in 2023. The frequency of such inspections depends on the risk group in which the company has fallen.

You can check whether the company is included in the list of employers whose activities are classified as a particular risk category in a special section on the website of the Federal Service of Labor and Employment (Rostrud). The frequency of inspections by the labor inspectorate is determined depending on the category:

  • high risk category – inspection is carried out once every 2 years;
  • significant risk category – the audit is carried out once every 3 years;
  • medium risk category – inspection is carried out no more than once every 5 years;
  • moderate risk category – inspection is carried out no more than once every 6 years;
  • low risk category – no verification is carried out.

In order to find out if your company is going to be audited, you need to find its name in the list or search the same list by Tax Payer Identification Number (TIN). The list of companies is divided into regions of the Russian Federation.

We kindly remind you that Rostrud authorities have introduced a moratorium on scheduled inspections until the end of 2022. However, if the inspectorate receives a complaint or confirmation of a violation of labor laws, the employer faces an inspection. Also, the moratorium does not apply to organizations that:

  • use objects of high and extremely high risk;
  • carry out licensed activities in the field of control over compliance with license requirements;
  • received a fine in accordance with the Code of Administrative Offenses for a gross violation, as well as suspended their activity or license.
